Welcome to the Hot Cares NPC website (the “Site”). Any person (“you” or “user”) that accesses or uses this Site agrees to comply with and be bound by the following terms and conditions (“Terms”). These Terms are binding and enforceable against all persons that access the Site or any part thereof.

All content, materials, and features on this Site, including text, graphics, logos, and images, are the property of Hot Cares or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without express written permission from Hot Cares.

HOT CARES NPC TERMS AND CONDITIONS OF USE

    1. The User accepts and acknowledges that submitting comments or any other content (excluding personal information) on the Site, grants Hot Cares and its affiliates a non-exclusive, perpetual, irrevocable right and licence to use, reproduce, publish, translate, sub-license, copy and distribute such content in whole or in part, to incorporate it in other works in any form, media, or technology now known or hereinafter developed, for the full term of any copyright that may exist in such content.
    2. All rights not expressly granted are reserved and no right, title or interest in any proprietary material or information contained in this Site is granted to a User.
    3. Unless a User has obtained written consent from Hot Cares, no proprietary material from this Site shall be copied or retransmitted.
  1. DONATIONS AND FINANCIAL TRANSACTIONS FROM DONORS

If you choose to make a donation through this Site, you agree to provide accurate information, including your payment details. We use a secure payment method to process transactions, however, we cannot be held liable for any fraudulent activity. You acknowledge that the security of your personal banking information remains your responsibility. All donations are final and non-refundable unless otherwise specified.

By participating in Hot Cares initiatives, nominator and nominee expressly consent to the processing of their personal information for the purposes of transacting with third parties and managing any information regarding the recipient in their capacity as a customer of Hot Cares.

If any nominator and/or nominee provides false or misleading information to obtain assistance, Hot Cares reserves the right to immediately cancel any assistance agreed upon. The integrity of our support programmes is paramount, and any form of deception will not be tolerated.

All assistance provided by Hot Cares must be utilized within the stipulated time period, with the maximum time period within 12 months from the date of approval. If the assistance is not used within this time frame, the commitment shall automatically fall away.

Funds or assistance provided by Hot Cares shall be used solely for the intended purpose as agreed upon at the time of approval. Recipients are prohibited from exchanging or utilizing the assistance for any other purpose other than that which was originally agreed. Nominators and nominees are not permitted to contact suppliers, donors, or any third parties involved with Hot Cares directly. All communication and inquiries must be directed to Hot Cares. This policy is in place to ensure that all interactions are managed appropriately and maintain the integrity of our programmes.

Hot Cares will not be liable for any commitments or services provided by suppliers, donors, or third parties. Additionally, we shall not be responsible for any loss, damage, or harm that may arise from interactions or transactions with third parties. Recipients acknowledge that any reliance on services or commitments made by third parties is at their own risk.

While we strive to provide accurate and up-to-date information, we make no representations or warranties of any kind regarding the completeness, accuracy, or reliability of any information on the Site.

These Terms shall be governed and interpreted in accordance with the laws of the Republic of South Africa. The User’s continued use of the Site shall constitute his/her consent and submission to the jurisdiction of the South African courts regarding all proceedings instituted by either party against the other, arising from any of these Terms.

Hot Cares reserves the right, in its sole discretion, to amend these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on this Site. The revised Terms shall supersede and replace any previous Terms. The User’s continued use of this Site subsequent to the posting of the revised Terms shall constitute the User’s acceptance to be bound by these Terms.

CONFIDENTIALITY Users agree that they shall not disclose to a third party any confidential information acquired in connection with access or use in any form except as authorised by Hot Cares at the time of the disclosure. Users must notify Hot Cares in the event that they become aware of any loss or unauthorised disclosure of the information.
  2. All Users hereby agree and acknowledge that any reproduction of confidential information will remain the property of Hot Cares or the third party that has prepared such information.
